The McKinney-Vento Homeless Assistance Act is a federal law designed for PreK–12 children and youth experiencing homelessness. It ensures that children have equal access to the same educational resources as other students.
What's considered homelessness?
Under 42 U.S.C. §11431, a student is considered homeless if they lack a fixed, regular, and adequate overnight residence. Examples include:
- Sharing housing with others due to loss of housing, economic hardship, or similar reasons
- Living in motels, hotels, emergency or transitional shelters
- Living in places not designed for regular sleeping
- Living in cars, public spaces, abandoned spaces, or similar settings
McKinney-Vento provides the right to enroll immediately, without requiring proof of residency or other standard paperwork.
It also provides access to free credit recovery, mental health coaching, and tutoring through Title IX, Part A.
